52 Senators Vote For, 47 Senators Vote Against Passage of Patriot Act

Today CNN headlines read “Patriot Act renewal fails in Senate.” Newmax headlines read “Senate Rejects Extension of Patriot Act.” The New York Times headlines read “Senators Thwart Bush Bid to Renew Law on Terrorism.” The Washington Post headline reads “Patriot Act is Blocked in Senate” and CBS News headline reads: “Senate Defeat For Patriot Act.”
All these headlines refer to the same story: 47 Senators used a senate rule to prevent 100 Senators from being able to VOTE for the reauthorization of the Patriot Act. 41 of those voting to uphold a filibuster by members of their political party were Democrats. One was an independent socialist, Bernie Sanders, who votes almost always with the Democrats. One was Republican Majority Leader Bill Frist who voted “no” to permit him to call later for reconsideration of the bill and four Republican senators, Craig of Idaho, Hagel of Nebraska, Sununu of New Hampshire and Murkowski of Alaska voted with the 41 Democrats and the one socialist.
However, the MAJORITY of the senate, consisting of 51 Republicans and one lone Democrat, Senator Ben Nelson of Nebraska- voted FOR H.R. 3199 which the House of Representatives passed on Wednesday by 251 by 174. HR 3199 is described as “A bill to extend and modify authorities needed to combat terrorism, and for other purposes “
Strangely, NO headline that I read told readers that 52 Senators, the majority in fact, voted FOR passage of the Patriot Act. Again, a minority took control of the Senate, through its archaic rules.
Of course, the President of the United States is in favor of extending the Patriot Act which was originally passed on October 24, 2001. The provisions in the bill were not new. They were expansions of existing Title 18 Code Crime laws which were already in force and already extensively used in stopping crime syndicates. Some of the provisions expanded to include terrorists were first passed in the 1930s by a predominately Democrat Congress and a Democrat President.
For example, decades old provisions outlawing mail fraud were expanded in the Patriot Act, in section 202 of the Patriot Act which expanded existing mail fraud law to include electronic communication fraud too as follows:
SEC. 202. AUTHORITY TO INTERCEPT WIRE, ORAL, AND ELECTRONIC COMMUNICATIONS RELATING TO COMPUTER FRAUD AND ABUSE OFFENSES.
Section 2516(1)(c) of title 18, United States Code, is amended by striking `and section 1341 (relating to mail fraud),' and inserting `section 1341 (relating to mail fraud), a felony violation of section 1030 (relating to computer fraud and abuse),'.
That seemed like a good idea following the terrorist bombing of the World Trade Center and the Pentagon, especially since terrorists use electronic communication more than they use the US Mail. Remember all the careful inspections that took place after the first letters with anthrax in them showed up at the U.S. Congress just a few years ago? All that effort to make sure there were nothing in letters being sent to members of Congress that would kill them was authorized under – Section 202of Title 18 in the EXISTING U.S. Criminal Code on mail fraud.
Section 202 is one of the sections that will no longer be in force if the Patriot Act is not renewed – and that exactly is the goal of those who voted to not allow the entire senate to vote on HR 3199 yesterday. They do not want Section 2516 of Title 18 of the United States Criminal Code to be expanded to include computer fraud committed by criminal syndicates, drug dealers and terrorists, and are making every effort to use Senate rules allowing a minority to block the majority to prevent it from happening.
In fact, the Democrats announced their “victory” on their party website as follows:
“In a victory that respects the basic civil liberties Americans have had for over 200 years, today the U.S. Senate refused to invoke cloture on the reauthorization of the USA PATRIOT Act. Senate Democrats led the charge against the overreaching bill, which was supported by the Republican leadership and the White House.”
I bet you didn’t know until you read the above that for 200 years computer fraud has been protected by the U.S. Constitution whereas mail fraud has been prevented by that very same Constitution.
According to the Department of Justice, as of March 10, 2005, section 202 of the PATRIOT Act on two occasions. These two uses occurred in a computer fraud investigation that eventually broadened to include drug trafficking.
What is really going on here, is the Democrats are hoping to trash the Republican President and use a totally fake issue like the reauthorization of the Patriot Act to get the great victory for freedom that took place in the Iraq elections on Thursday off the front pages when millions of Iraqis freely chose a new government. Their hope is that by misleading the American people on this issue they can take back the Congress in 2006 and then the White House in 2008.
It certainly does not appear to me that the Democrats have ANY interest in fighting the war on Terror. Their only concern appears, at this point, to be to somehow get control of the Congress again – now that they have lost their hope of controlling the judiciary due to Bush’s nominations of current Chief Justice John Roberts and Samuel Alito, who seems assured of approval.
Unfortunately, with most of the media willing to help them in their cause, many people will be and are being deceived. However, for the informed now is the time to take note of the senators who are on the wrong side of history and work to retire them from the Senate when they are up for re-election.
