Be Afraid, Be Very Afraid
By Roxanna Moser (10/28/08)
Yet another quote from The One showing why we should fear his presidency and judicial appointments. ". . . the Warren court wasn't that radical. It didn't break free from the essential constraints
that were placed by the Founding Fathers." The Supreme Court, nor any other court, is supposed to "break free from the essential constraints" of the Constitution. To do so is to reduce the Constitution to nothing more than a starting point for doing anything.
In voting against John Roberts and Samuel Alito, Obama said that it
was the role of a justice to favor the weak over the strong. No, it
is not. Obama also stated that "In those difficult cases, the
critical ingredient is supplied by what is in the judge's heart."
No, it is not.
It is the responsibility of judges to decide a case based on the
facts, the evidence, and the law. Obama's idea of what the justice
system "should" do is as far removed from what it actually should do
as the east is from the west.
For instance, a little old lady is taking on a giant, multinational
corporation. Damn the facts? Damn the evidence? Damn the law?
According to Obama, the judge should find for her simply because she
is weak and the giant corporation is strong. Well, why bother with
lawsuits then? Just have the person who thinks they've been wronged
write a figure he/she is willing to accept and then submit it to the
corporation, which has 30 days to pay. Is that justice? No, that's
extortion.
Another for instance, a black man sues a white man. The white man is
in the wrong, but "what is in the judge's heart" is that he's a
bigot, and he's not going to issue a ruling in favor of a black man.
Is that justice? Is that what Obama envisions?
Hey Obama, seen Lady Justice lately? She has a blindfold over her
eyes, and that's the way it should be. Once rulings can be based on
what is in a judge's heart, Katy bar the door. Obama's way is the
way of kangaroo courts. Obama's way is the way of anarchy and chaos.
And, all of the mindless minions who hang on every word The One
speaks have no comprehension that they won't like it when passion and
not the law rules the courts.
On January 20, 2009, the new President will take an oath to protect
and defend the Constitution from all enemies, foreign and domestic.
If Obama's the one taking that oath, he'll have one hand behind his
back with his fingers crossed, as he's obviously already decided that
the "Constitution is a charter of negative liberties" and "essential
constraints" from which judges should break free. The biggest
domestic enemy of the Constitution will be the President himself.
